He was charged after an incident in July which he threatened to stab Senior Constable Todd Cremer in front of his children.
Winch represented himself during the proceedings at Nowra Local Court on Tuesday, October 6, and denied all allegations.
Senior Constable Cremer said he was called to a Kangaroo Valley property on July 9 by two people who reported Winch had been at the premises, in contravention of an AVO.
"I identified an individual near the property as Mark Winch, and told him he was under arrest for breaching his AVO," Senior Constable Cremer said.
"He said 'get f***ed, I'm not Mark Winch you c***'."
Senior Constable Cremer said he was able to identify Winch because he had met him the week prior at an unrelated incident near Shoalhaven Heads.
A struggle ensued after the arrest in Kangaroo Valley. After the struggle, Winch continued to call Senior Constable Cremer names and threatened to stab him.
During the drive to Nowra Police station Senior Constable Cremer said he "had to turn up the radio" in an attempt to drown out Winch's threats.
Winch, however, alleged that Senior Constable Cremer had "spear-tackled" him, and denied ever meeting the officer prior to the arrest.
"I never met him in Shoalhaven Heads, that bothers me dramatically," he said.
"I didn't threaten to kill people, I'd punch him in the face but I'm not a murderer.
"The way I was treated was despicable. The last copper in the Valley, I've punched on with him but he was a good bloke. This one, I don't think he should be a police officer."
When placed under oath, Winch said, "I have a god in me and a devil in me."
He vehemently denied that he suffered from any mental illness, but acknowledged he had a substance abuse problem.
The presiding magistrate described Winch's evidence as "a little bit iffy".
"In my view Senior Constable Cremer gave very careful and reliable evidence," the magistrate said.
"I think you may have gotten a bit confused, and I find the offences proven."
Winch has been in custody since his July 9 arrest. He was sentenced to a seven-month community corrections order, and ordered to seek treatment for drug and alcohol issues.
