Derrick Allred, 61, has pleaded not guilty to operating a commercial vessel negligently causing death/grievous bodily harm in a case brought by Transport for NSW.
It is alleged Allred was using the boat PARTYN2 on St Georges Basin around 2.30pm on January 25 this year when a person he was attempting to retrieve was struck and injured by a propeller.
The alleged incident happened about 100 metres northwest of Bonito Point on the Sussex Inlet side of St Georges Basin.
Court papers stated Allred was driving the vessel which had made a turn to retrieve the person.
It is alleged he pulled up next to the person, meaning they had to swim across the motor's path, which it is claimed wasn't turned off, to gain access to the boat.
In doing so was struck by the propeller.
The matter will return to court on August 24.
