Benjamin Joseph Boyle, 38, pleaded not guilty to charges of driving a vehicle with an illicit drug present, possessing a prohibited drug, possessing or using a prohibited weapon without a permit, possessing an unauthorised pistol and possessing ammunition without holding a licence.
Court papers said Boyle was stopped by police in a black Subaru station wagon on Sussex Inlet Road around 3pm on October 20, 2017, after officers had allegedly initially spotted his vehicle 500 metres off the road in bushland.
Officers conducted a random breath test which returned a negative result.
Court papers said Boyle’s arms and legs were shaking as he spoke to police, and he had bloodshot eyes, which led officers to believed he might have been drug affected.
A random drug test allegedly produced a positive result.
A search of the vehicle allegedly found a quantity of drugs, drug administering utensils and black and clear coloured gas (carbon dioxide C02) handgun with a laser site.
Court papers said the weapon was capable of firing six millimetre metal ball bearings.
Officers allegedly found the gun and five bags of ball bearings, totalling several hundred projectiles, under a rear car seat cover.
Officers allegedly also found an ice pipe under the vehicle’s steering wheel, and a plastic bag containing drugs inside a black sunglass cover under the passenger seat, which testing later revealed to be 2.2 grams of methylamphetamine, or ice.
Boyle will reappear in Milton Court on April 5.
