Surya Teja Penugonda, 24, of Harris Park in Sydney, pleaded guilty to both charges.

He had four other people in the car when he was pulled over by police just south of Nowra on July 8.

Court papers said police had received calls about the manner in which a Mitsubishi 380 sedan was being driven on the Princes Highway at Falls Creek.

Officers spotted the vehicle at the Quinns Lane roundabout at South Nowra about 6.26pm, stopping the car near the intersection of Kinghorne Street.

Court papers said officers had witnessed the vehicle swerving between lanes and it almost collided with the nearside gutter when it came to a stop.

Officers said Penugonda smelt strongly of intoxicating liquor when they approached the vehicle, however he told officers he had had nothing to drink.

Checks revealed he was driving on an international licence, was originally from Telangana in India and had been disqualified from driving for a minimum of 12 months after being caught high-range drink driving on January 6.

He was also to have a interlock device fitted to his vehicle.

It took three attempts to successfully provide a breath test, which produced a positive result and later a breath analysis of 0.162.

Police said his eyes were bloodshot, his pupils dilated, his breathing was slow, speech was slurred and he was clumsy.

He later told police he had drunk six glasses of wine from a self pouring cask at Hyams Beach between 12.01am and 11am that day.

He told officers he was in Australia on a student visa and questioned if these offences would cause that visa to be cancelled.

In Parramatta Local Court on Wednesday, September 6, Magistrate Brett Shields placed him on a 10-month suspended sentence and disqualified him from driving for nine months. He also fined him $750 and ordered he have an interlock device fitted to his vehicle for four years.
