Instead Clifford Thomas, 25, has been placed on an intensive corrections order for 15 months, meaning he can serve his sentence in the community.
In Nowra Local Court, Magistrate Gabriel Fleming also ordered he must undertake drug and alcohol counselling, sexual offence counselling and must enter into and remain in full time rehabilitation if offered a place.
Thomas pleaded guilty to two counts of carrying out a sexual act with another person without consent, two counts of behaving in an offensive manner near a public place/school and stalking.
He also pleaded guilty to using a carriage service to menace/harass/offend.
He was also convicted of entering enclosed lands and a further charge behaving in an offensive manner but no further penalty was imposed.
Court papers said Thomas masturbated in front of the same woman on a number of occasions on the Shoalhaven River levy walking trail in February this year.
