A spokeswoman for the Chief Minister said the bill passed, which allows adults to posses up to 50 grams of cannabis, would be a challenge to do in the Jervis Bay Territory.

"The exemption only operates for cannabis possessed in the confines of the ACT. At this time, it will not be implemented in the Jervis Bay Territory," A spokeswoman for the Chief Minister said.

"This is due to the increased complexity in applying these laws, and how they would interact with Commonwealth Law, in the Jervis Bay Territory.

"The ACT Government has also committed to closely monitor the implementation of these Laws in the ACT, which would be challenging to do in Jervis Bay.

"The ACT Government will work with relevant authorities in the Jervis Bay Territory to ensure that residents are aware of the laws regarding the possession of cannabis that will continue to apply in the area."

Member for Fenner Andrew Leigh earlier today also confirmed the laws won't apply in Jervis Bay.

"The exemption to the offence only applies for possession or cultivation in the ACT," Mr Leigh said.

"That does not include the Jervis Bay Territory."

The laws remove any penalty for possessing up to 50 grams of dry cannabis, or 150 grams of "fresh cannabis" and for growing up to two plants.

Home Affairs Minister Peter Dutton has described the new laws as unconscionable and confirmed the federal government is looking into removing them.

The High Court in 2013 threw out the ACT's legalisation of Same Sex Marriage, ruling it was inconsistent with the Federal Marriage Act.

Regardless, for ACT residents the laws don't come into force until January 31, 2020.
