It is believed DPP solicitor Robert Taylor reported the sentence to a DPP deputy director who reviewed the case but decided the department would not appeal the sentences.
Joshua Chamberlain, 19, of McKay Street, Nowra and Wade Malcolm Dunley, 39, of Bunberra Street, Bomaderry pleaded guilty to vicious bashing of 76-year-old Francois Beugels.
The men pleaded guilty to aggravated assault with intent to rob with wounding with Judge Chris Hoy sentencing both men to six years in jail, with a non-parole period of three-and-a-half years.
