Shoalhaven City Council ordered the landowner of 5 Nobblers Lane, Terara, to demolish the shed and remove the shutters on May 30.
However, council has now agreed to extended the order to comply with development consent until September 29, 2017.
A cease of use order was also issued to the tenant, a not-for-profit organisation, which is using the land, zoned for rural industries, as a gym.
The premises has been operating as an unapproved gym on a regular basis since the closure of the Slice Of Life Australia sustainable garden project.
”The subject land zoning is RU1 - Primary Production,” a council spokesman said.
“The current use is not in accordance with the development consent.
“However, the Shoalhaven Local Environmental Plan 2014 does not prohibit the use of the land as a community facility, subject to development consent approval.”
Previously, Shoalhaven City Council building and compliance manager Colin Wood said the shed and shutters had not been approved and were erected by the tenant without the landowner’s consent.
