Convicted insider trader Oliver Curtis should not be sent to jail because he has already been the subject of "inaccurate, harassing, vile and scandalous" commentary on social media and his risk of reoffending is "non-existent", according to submissions filed in the Supreme Court.

Curtis, 30, was found guilty on June 2 of conspiracy to commit insider trading with his former best friend John Hartman after a 12-day trial and two days of deliberations by the jury.

He was released on bail pending Justice Lucy McCallum's decision on sentence, which will be handed down on Friday.

His wife, high-profile Sydney publicist Roxy Jacenko, has urged the court not to impose a jail sentence on him, saying he is a "kind, considerate, honest and reliable man".

The founder of PR firm Sweaty Betty and children's hair accessory business Pixie Bows said in an impassioned reference in support of her husband that she had "no doubt" he would never offend again.

Ms Jacenko said that, before her attendance at the trial, she had "limited knowledge" of the case against her husband and the events occurred before she met him in June 2010, when he was 24 but "mature beyond his years".

His pursuit by authorities for insider trading was "not something we discussed at the time" and she only became aware the matter was still being pursued when he was served with a court attendance notice in January 2013.

"The nature of the offence is out of character for the person that I know," Ms Jacenko said.

"There has never been a moment that I have had any doubt about his integrity or morals. Oli is a kind, considerate, honest and reliable man."

At a sentencing hearing last Friday, the Crown urged Justice McCallum to impose a jail sentence on the former banker.

But defence counsel Murugan Thangaraj, SC, says in written submissions that the court should "reject any suggestion that imprisonment is the only manner in which an individual can be punished for their crimes".

Mr Thangaraj said the level of "public shaming" in this case was a factor weighing against a custodial sentence.

Social media commentary had been "inaccurate, harassing, vile and scandalous", he said. This included "vile jokes" such as "maybe we could put a camera inside Curtis' colon to see what happens in jail".

Curtis' father Nick, the former chairman of rare earth miner Lynas Corporation, said in a separate reference that at the time of the offence his son was a "brash youth who turned 22 in August of 2007" and his risk of reoffending was "non-existent".

He said the events had "had a profound impact on his life, and have clearly marked him deeply".

"They do not, however, describe the man I know today," Mr Curtis said.

James Henderson, managing director of Curtis' former employer, Transocean Group, said he continued "to regard Oliver with affection and respect" and he found "the conviction surprising and not at all in keeping with the man I know".

Ms Jacenko was one of a raft of family members, friends and business people who tendered character witness evidence in support of her husband.

Her mother, Doreen Davis, said she loved Curtis "for his devotion to whoever is in need of a helping hand".

"He is suffering greatly at the moment and it is painful to see it," she said.
