Dr Christine Daly was prosecuted by the Health Care Complaints Commission before the New South Wales Civil and Administrative Tribunal last week.
It was alleged that Dr Daly showed professional misconduct by Dr inappropriately prescribing of drugs of addiction, as well as poor clinical record keeping, in relation to her care of 12 patients.
Dr Daly conceded that all of her records for the relevant patients didn’t comply with regulations and were significantly deficient. She described her records for these patients as “woeful”
It was further alleged that Dr Daly didn’t obtain authorities before prescribing Schedule 8 drugs for nine patients and that this conduct amounted to a breach of the conditions previously placed on her registration by the Medical Board of NSW.
The Tribunal held, “the serious nature of the numerous incidents of lack of appropriate clinical judgment, failure to maintain appropriate records and the breach of conditions cumulatively justifies a finding of professional misconduct.”
The Tribunal reprimanded Dr Daly and ordered that a number of conditions be imposed on her registration, including that she is only to practice only in a group practice and must engage in a period of mentoring.
Dr Daly also submitted to an audit of her medical practice and must compete a course in prescribing offered by Monash University.
Dr Daly practiced medicine in Nowra as a sole practitioner for approximately 25 years.
