Pecuniary interest sees plan go down the chain of command

A DRAFT Local Environment Plan for the Shoalhaven has been adopted and will be put to the public, but it was not as simple as a show of hands in council.

Dealing with the matter had been put off at previous ordinary meetings, with council failing to reach a quorum on the issue due to pecuniary interests.

Each councillor was a property owner in the city, automatically making them ineligible to vote on the document as a whole.

Local Government Department deputy director-general Ross Woodward said it was not uncommon for councils to find themselevs in that situation when dealing with a city-wide issue.

The general manager Russ Pigg made submissions to the Local Government Department on behalf of council and the motion was deferred to the extra-ordinary meeting last week.

Council was informed Mr Pigg could adopt the draft LEP under delegated authority.

However, a roadblock was hit when Mr Pigg declared a pecuniary interest with regards to parts of the draft LEP dealing with two land zones.

Mr Pigg adopted the bulk of the document with which he had no pecuniary interest.

The remainder was left in the hands of the assistant general manager John Gould, bringing proceedings to the second roadblock of the evening.

Like Mr Pigg, Mr Gould declared a pecuniary interest in one of the same sections as the general manager and was only able to adopt the other.

Once again the final element of the draft LEP was handed down the ranks to the director of development and environmental services, Tim Fletcher.

The draft LEP 2009 will be placed on public exhibition.
